Incident at vicinity of 45N 40W

Summary

2014-11-04: UPDATE TSB: A13A0023: The AirMed International British Aerospace 125-800 aircraft (N812AM) was enroute from Santa Maria, Azores to St. John's. While in cruise flight at FL400 over the North Atlantic the crew advised Santa Maria that they could not maintain the assigned altitude and requested a lower flight level. Due to conflicting traffic the requested flight level was not available. While still in Azores' airspace, the crew declared an emergency and descended to FL365. A loss of separation occurred while still in Azores' airspace.
2017-03-06: N812AM, BAe 125-800, enroute from Santa Maria (LPAZ) to St. John?s (CYYT), was coordinated at 40,000 feet by Santa Maria Oceanic on routing 40N 030W 45N 040W 48N 050W. At 13:47Z N812AM advised Santa Maria that they could not maintain 40,000 feet; however there was traffic so a lower flight level was not available. At 14:11Z, while still in Santa Maria airspace, the pilot declared an emergency and descended to 36,500 feet. Separation losses occurred with Santa Maria airspace. Traffic information was passed with two aircraft and Santa Maria subsequently coordinated 39,000 feet with Gander Oceanic. N812AM climbed to 39,000 feet and reported at the Gander/Santa Maria boundary at 39,000 feet at 14:21Z. Santa Maria is processing the balance of the documentation. TSB Case Closed.
