Incident at Approximately 49N 047W (ATS operating irregularity)


2010-09-14: UPDATE TSB: A10A0093: N361K, a corporate Dassault Falcon 900, was en route from Nice, France to Gander at F360. KLM686, a KLM Royal Dutch Airlines Boeing 747-400, was en route from Mexico City to Amsterdam at F370 on a converging track with N361K. The flight crew of N361K requested and received a clearance to climb to F380. The clearance was issued without a restriction and though the required separation of 15 minute lateral and 1000 foot vertical was maintained, separation between the two aircraft was not assured. NAV CANADA is convening an OSI Level One into the incident.
2010-09-07: N361K, Dassault Falcon 900, enroute from Nice (LFMN) to Gander (CYQX), was issued clearance to climb from 36,000 ft. to 38,000 ft. without restriction with opposite direction KLM686, Boeing 747-400, enroute from Mexico City (MMMX) to Amsterdam (EHAM) at 37,000 ft. Clearance was issued with ample time to reach the cleared altitude prior to the time required but without a restriction issued, separation was not assured. TSB Case Closed.
