Incident at Approximately 40 miles west northwest of Fredericton (CYFC) (Conflict - potential, Conflict - IFR & VFR, Communication navigation surveillance/air traffic system)

Summary

2010-07-09: Controller was handed off a VFR flight (N945CC) enroute from Québec (CYQB) to Halifax (CYHZ) at 17,000 ft. from Boston and was informed that the aircraft was landing in Fredericton (CYFC). There was a departing JZA flight (JZA957) enroute from Fredericton Toronto (CYYZ) that was climbing to 28,000 ft. and cleared to remain south of the incoming N945CC. The N945CC was actually proceeding to Halifax and before the situation could be corrected the flights passed with less than the required separation. TSB Case Closed.
2010-07-13: UPDATE TSB: A10A0075: The US corporate owned Sabreliner (N954CC) was handed off by Boston Control Center to Moncton Control Center at 1407 ADT. Boston Control Center advised that the Sabreliner at 17000 ft was VFR and was landing at Fredericton. JAZZ 957 a CRJ2 (C-GKER) departed Fredericton for Toronto and was cleared to FL 280 direct to Beauce VOR to remain south of the Sabreliner. The Sabreliner was actually enroute to Halifax (not Fredericton as indicated by Boston Centre) and the two aircraft passed 2.9 miles laterally and 700 ft vertically 40 NM WNW of Fredericton. Neither aircraft reported a Traffic Collision Avoidance System alert; no evasive action was taken.
