Incident at GREATER MONCTON ROMEO LEBLANC INTERNATIONAL AIRPORT (Conflict - loss of separation, Alleged Canadian Aviation Regulations (CARs) infraction)

Summary

2010-05-31: WJA568, inbound to Moncton (CYQM) enroute from Hamilton (CYHM), was cleared to 5,000 ft. MFCLG 04, on a local IFR flight, was cleared to 4,000 ft. Traffic was passed to both aircraft including the cleared altitude of each. The PA44 was observed climbing through 4,400 ft. and was reminded of the cleared altitude. The flight immediately descended to 4,000 ft. When the aircraft were three miles apart they were separated by 700 ft. vertically, when they were two miles apart they were separated by 900 ft. and increasing. There was minimal impact on operations.
