Incident at East of 52N 050W

Summary

2010-03-16: UPDATE TSB: A10A0027: JEI212, a Jet Executive Lear LJ35, was en route from Gander to Reykjavik at F410 when the flight crew requested a lower altitude due to fuel temperature. Gander advised that a lower altitude was not available due to traffic after which the crew declared an emergency, executed the NAT contingency procedure and descended to F390. A short time after reaching F390, the crew was issued a new clearance and the aircraft continued to destination exiting Canadian airspace without further incident.
2010-03-09: JEI212 (Jet Executive), Learjet 35A, enroute from Gander (CYQX) to Reykjavík (BIKF), was routing between 52N 050W and 58N 040W at 41,000 ft. when the crew requested a lower altitude due to fuel temperature. A lower altitude was not available due to traffic resulting in the crew declaring an emergency and descending to 39,000 ft. without an IFR clearance. The aircraft was given a new clearance at 39,000 ft when ATC was able and the flight continued to destination. TSB Case Closed.
