Incident at Gander Domestic FIR Bancs (Conflict - loss of separation, Alleged Canadian Aviation Regulations (CARs) infraction, ATS operating irregularity)


2005-08-11: At 1624Z westbound COA81, B762,enroute from Geneve to Newark position BANCS, radar identified at FL360, made climb to FL370 without climb clearance. The flight had been advised to expect climb to FL370. Preliminary investigation indicates pilot reported leaving FL360 for FL370 but the controller did not detect the discrepancy in readback. Traffic at time of climb was westbound UAL915, B772,enroute from Paris to Washington Dulles eight (8) minutes in trail at FL370 and not radar identified until 1627Z. Required longitudinal separation was ten (10) minutes until both aircraft radar identified. TSB Case Closed .
