Incident at Gander Domestic (Conflict - loss of separation, Communication error)

Summary

2005-07-04: COA95, Boeing 757-224, reported 51N50W at 1344Z, maintaining 32,000 ft and requesting 36,000ft. At 1345Z COA95 observed climbing thru 32,700ft. When queried by controller pilot confirmed climbing to 36,000ft with understanding that clearance had been issued to maintain 36,000. Flight then cleared to maintain 33,000. Highest observed altitude was 33,300. Potential traffic, EIN105 Airbus 330-300 enroute from Dublin (EIDW) to JFK New York (FJFK) was five (5) minutes in trail at 36,000. Vertical separation required was 1000 feet. TSB Case Closed.
