Incident at 60NM South of LFVP (Alleged Canadian Aviation Regulations (CARs) infraction, ATM - other)

Summary

2005-06-15: AT 0945 UTC GANDER ACC WAS CONTACTED BY AN DAM0110, A HAWKEYE E2C AIRCRAFT AT FL220 60NM SOUTH OF LFVP. NO FLIGHT PLAN FILED OR IFR CLEARANCE. NORAD, ATC AND TRANSPORT CANADA UNAWARE OF ACTIVITY. ATC DETERMINED THAT THE FLIGHT WAS OPERATING FROM THE FRENCH AIRCRAFT CARRIER CHARLES DE GAULLE, AT POSITION 4630 NORTH 5705 WEST. FURTHER INVESTIGATION REVEALED SEVERAL OTHER AIRCRAFT OPERATING IN CONTROLLED AIRSPACE WITHOUT IFR CLEARANCES. FLS 180 TO FL450 WERE OBSERVED AND REPORTED TO ATC BY THE FRENCH AIR FORCE. DISCUSSIONS BY ATC WITH THE MISSION COORDINATOR ON BOARD THE CHARLES DE GAULLE INDICATED THAT THEY WERE OPERATING UNDER INTERNATIONAL REGULATIONS THAT REFER TO ""DUE REGARD."" ATC DID NOT APPROVE ANY AIRSPACE BLOCK AND EXPRESSED ITS CONCERN FOR SAFETY WHEN THIS TYPE OF FLIGHT EXERCISE TAKES PLACE IN CONTROLLED AIRSPACE WITHOUT PRIOR APPROVAL AND COORDINATION. INFORMATION WAS OBTAINED FROM THE FRENCH MISSION COORDINATOR AS TO THE TIME AND AREA OF ACTIVITY THAT WOULD BE AFFECTED. EXERCISE SCHEDULED TO BE COMPLETED AT 1500UTC. EASTBOUND MTT IN AREA OF ACTIVITY. CIVIL AIRCRAFT WHEN REQUIRED WERE ADVISED OF POSSIBLE MILITARY ACTIVITY ALONG ROUTE OF FLIGHT. Nil TSB
