Incident at Approximately 50N49W


2005-04-07: At 0514Z N9UP F390 six minutes East of 50W advised unable to maintain F390 due temperature and requested F370. ATS advised the aircraft unable the requested level or descent clearance due traffic. N9UP followed contingency procedures and started a descent. ATS advised the aircraft there was no traffic at F350 and the aircraft continued the contingency descent to that level. ATS then issued a revised oceanic clearance. Nil TSB.
