2005-02-02: ACA889 B763 Enroute from London Heathrow to Ottawa International . At 2223Z aircraft reported level at FL400. Aircraft had climbed from FL380 to FL400 without clearance from Moncton ACC. When queried where he had received his clearance to climb the pilot responded ""from Gander ACC"". Clearance was received on a relay from a BAW flight. Investigation continuing. No traffic involved. TSB Case Closed .
2005-02-14: TSB Update: #A05A0014: ACA889, an Air Canada Boeing 767, was en route from London Heathrow to Ottawa at F380 when the flight crew climbed the aircraft to F400 and reported level with Moncton ACC. When the controller queried the crew, they reported that they had received a climb clearance from Gander ACC. Moncton ACC personnel contacted Gander ACC and were informed that they had relayed a clearance to climb to F400 to Air Canada flight ACA1899 through another aircraft. The crew of ACA889 inadvertently thought the clearance was for them as they had been trying to contact Gander and request a climb to F400. There was no other traffic affected. NAV CANADA is conducting an investigation into the incident. Air Canada safety personnel will be providing a report to the TSB.
