Incident at GANDER INTL NL (CYQX)

Summary

2003-12-19: TSB Update - A03A0132: The Air France A340-300 operating as AFR321 at FL370 had planned for FL380 for the Oceanic crossing. The crew advised ATC that the flight would like to climb to FL380 in the vicinity of VIXUN intersection. ATC instructed the crew to advise when ready to climb. At approximately 30 NM West of VIXUN, AFR321 commenced the climb to FL380 without ATC clearance. Nil conflicting traffic was present at the time and ATC then issued the clearance for the flight to maintain FL380.
2003-12-16: Air France Flight 321 at FL370 which had flight planned at FL380 for the Oceanic crossing advised ATC they would like climb in the vicinity of VIXUN. The aircraft was instructed to advise when ready for climb. Approximately 30NM West of VIXUN the aircraft climbed to FL380 without clearance. There was nil Traffic.
