Incident at Gander Oceanic (Conflict - loss of separation, ATS operating irregularity)

Summary

2003-10-22: A Lufthansa Airlines A340 (DLH535) en-route from Caracas to Frankfurt was routing 44N/50W, 44N/45W, 47N/40W at FL350. The aircraft had flight planned 40N/50W, 44N/45W 47N/40W but was re-routed by New York. A Martinair Airlines B767-300 (MPH910) en-route from Margarita was routing 37N/50W, 46N/40W at FL350. Due to the steep angles, these aircraft operated in an area with less than the required minimum of 15 minutes longitudinal or 60 nautical Miles lateral. Safety was not assured.
