Incident at Gander Oceanic (Conflict - loss of separation, Alleged Canadian Aviation Regulations (CARs) infraction)
2003-03-26: TSB - 2003/03/25 - A03A0032: A Canadair (Bombardier) CL-600-2B16 (Challenger 604), N331FX, operated by Flex Jet, was en route from Rome to Gander at FL380 via 50N/20W, 52N/30W, 52N/40W and 50N/50W. USA3, a US Airways Airbus A330 was en route from Rome to Philadelphia at FL380 via 52N/20W, 53N/30W, 53N/40W, 52N/50W and DOTTY. The flight crew of N331FX reported by 20W with an estimate for 52N/30W and a next reporting point of 53N/40W. Both Gander and Prestwick ACC detected the incorrect reporting point and Prestwick ACC re-issued the original clearance which was via 52N/40W. The crew then reported by 30W with an estimate for 53N/40W and a next reporting point of 51N/50W. Separation between the two aircraft eroded to 35 nm laterally and approximately 14 minutes longitudinally in an area where 60 nm lateral or 15 minutes longitudinal separation is required. Gander ACC then re-cleared N331FX to FL390 and to resume the original flight plan tracking.
2003-03-10: A CL600 N331FX was en route from LIRA to Gander at FL380 50N20W(1414Z) 52N30W(1512Z) 52N40W(1601Z) 50N50W to Gander. Traffic an A330 at FL380 was 52N20W(1412Z) 53N30W(1501Z) 53N40W(1546Z) 52N50W DOTTY. N331FX reported 20W estimating 52/30 next 53/40, the incorrect position was detected by Gander and Prestwick and a clearance via 52N40W 50N50W to Gander was re-issued by Prestwick. N331FX then reported by 30W estimating 53N40W with the next 51N50W. The CL600 aircraft had failed to abide with clearance and was converging on an Airbus A330 without the required separation. The CL600 was queried and confirmed 53N40W and 51N50W. Gander then re-cleared N331FX to FL390 and back to 52N40W 50N50W. TSB - Case Closed - More to Follow
