Incident at RED DEER REGIONAL AB (CYQF) (Conflict - loss of separation, Alleged Canadian Aviation Regulations (CARs) infraction)

Summary

2001-01-12: KBA 103, a Beech King Air, departed Red Deer for Villeneuve on an IFR flight plan and the crew was cleared to 6,000 feet because of overflying northbound IFR traffic at 8,000 feet (C-GDFK). The crew of KBA 103 subsequently contacted the Controller and reported leaving 6,700 feet in the climb. The Controller stopped the a/c at 7,000 feet and queried the crew. Separation was lost when the two a/c came within 3 NM laterally in an area where 5 NM lateral or 1,000 feet vertical separation is required.
