Incident at en route from Frankfurt to Cancun (Conflict - loss of separation, ATS operating irregularity)


2001-10-23: TSB Update Oct 22, 2001. A01F0128: CFG156, a B767 en route from Frankfurt to Cancun at FL310 and position 47N 040W at 1446(Z) was estimating 42N 050W at 1559 (Z). MPH064, an MD-11 en route from Miami to Amsterdam, was at 42N 050W at 1555 (Z) and estimating 46N 040W at 1652 (Z)at FL290. The controllers at New York center queried Gander center whether CFG156 could climb to FL320. The Gander controller responded that FL320 for CFG156 was approved. However, no specific request to climb CFG156 to a higher altitude was made and the aircraft proceeded into New York controlled airspace at FL310. New York subsequently advised Gander that the two flights were involved in a loss of separation. CFG156 and MPH064 crossed tracks at 42N 050W with approximately four minutes spacing (based on estimates).
2001-10-15: CFG156 B767 enroute Frankfurt to Cancun FL310 47N40W 1446 est 42N50W 1559. MPH064 MD11 enroute Miami to Amsterdam 42N50W 1555 est 46N40W 1652. New York advised Gander that these flights were involved in a loss of separation and that they would be conducting an investigation. TSB Evaluating.
