Incident at CYAW (ATS operating irregularity)
2001-08-09: MRLN 421 SeaKing Helicopter , S61, was on a training flight doing approaches at CYHZ and returning to CYAW at 2400 feet , when PA30 was cleared for takeoff for an IFR clearance to level at 3000 feet . The take off clearance was authorized with no release from Moncton Centre . No Conflict . TSB: Case Closed .
2001-08-10: SHEARWATER CONTROL TOWER WAS PROVIDED WITH AN IFR CLEARANCE FOR C-GCTL, A PA30. NORMALLY, AND BY AGREEMENT, SHEARWATER TOWER WILL WAIT UNTIL IFR RELEASE IS AUTHORIZED BY ACC BEFORE CLEARING IFR AIRCRAFT FOR TAKE OFF. IN THIS INSTANCE THE AIRCRAFT TAXIED OUT ON SHEARWATER GROUND CONTROL FREQUENCY AND WAS ISSUED THE IFR CLEARANCE BY THE GROUND CONTROLLER. A SUBSEQUENT MIS-COMMUNICATION BETWEEN THE SHEARWATER GROUND CONTROLLER AND THE SHEARWATER TOWER CONTROLLER LED THE TOWER CONTROLLER TO BELIEVE THAT THE AIRCRAFT WAS VFR. THE AIRCRAFT was cleared FOR TAKE OFF PRIOR TO THE RELEASE BEING AUTHORISED. After C-GCTL DEPARTED, THE MONCTON IFR CONTROLLER SPOTTED THE TRANSPONDER CODE ON C-GCTL CLIMBING TO 3000 FEET. MONCTON QUERIED SHEARWATER AND THE ERROR WAS RECOGNISED. THE DEPARTING AIRCRAFT WAS GIVEN A VECTOR TO AVOID CONFLICT WITH MERLIN 421, A VFR MILITARY SEA KING HELICOPTER WHICH WAS RETURNING TO CYAW FROM CYHZ AT 2400 FEET. THERE WAS NO LOSS OF SEPARATION. DND WILL BE CONDUCTING A FLIGHT SAFETY INVESTIGATION.
