Incident at SAINT JOHN NB (CYSJ)

2001-07-30: C-GTOR HS25 was cleared for an IFR flight from Saint John to Montreal, with a departure restriction to climb runway heading to 8000 feet. The aircraft departed at 1945z, without turning on his transponder. On initial contact the controller asked the aircraft to turn on his transponder and identified the aircraft. When the controller informed the aircraft of radar identification, the aircraft (4000 ft.) started a right turn away from runway heading. The controller recognized the clearance deviation and assigned heading and altitude instructions. Pilot apologised for the deviation. ATC advised the pilot that a report would be filed. Nil TSB
