Incident at Fredericton NB

Summary

1999-11-08: ARN850 DH8 on initial contact with ATC was cleared to maintain 4000 feet due to ICN2281 ATR42 at 5000 feet inbound from Saint John. When 2 miles back from FRENN intersection ATC passed ICN2281 as traffic to ARN850 which was also 2 miles back from FRENN. ATC instructed ARN850 to stay at 4000 feet until by the other traffic. At that point ICN2281 cancelled IFR and descended into the flight path of ARN850 despite the fact the ARN850 crew advised ICN2281 that they would maintain 4000 until visual passage. It is estimated that ICN2281 passed within 2 miles and 400-500 feet in front of the ARN850 flight. A TCAS RA instructing the crew to descend resulted. TSB evaluating. TSB case closed.
