Incident at 50 NM west of Red Lake, ON (ATS operating irregularity)

Summary

1997-06-05: C-GWBT was on an IFR flight from Pickle Lake direct Red Lake direct Winnipeg at 16,000 feet. BLS 361 was on an IFR flight from Red Lake to Winnipeg requesting 16,000 feet but had stopped at 14,000 feet due to C-GWTB. BLS 361 was advised that he would get higher as soon as he was clear of the traffic. Shortly after, BLS 361 advised that he had his traffic in sight and requested a VFR climb to FL 180. The controller confirmed that the traffic in sight was C-GWBT and cleared BLS 36 to climb form 15,000 feet to 17,000 feet VFR and to maintain FL 180. As the controller was writing the clearance down on the flight progress strip, he began to doubt the correctness of the procedure. On consulting MANOPS, he discovered that he had misapplied the application of a VFR climb as it is not permitted in controlled airspace over 12,500 feet. He informed his supervisor and an investigation will be done. BLS 361 had C-GWBT in sight at all times and there was no risk of collision.
