Incident at Charlottetown PEI


1997-08-21: ACA649 DC9 was issued a SID departure on runway 21 at Charlottetown and departed 1820z. One minute later he was observed turning right. He appeared to be apprx 2000 feet above a VFR target. He had been passed traffic by Charlottetown FSS prior to switching to ACC frequency. He called in apprx 1804z heading 280 degrees. When queried, he advised that he had a TCAS advisory but no TCAS resolution. Even though the TCAS showed him above his target, he said that the weather was VFR he turned since he felt he was too close. He turned towards a C130 traffic descending to 7000 feet but assuming he didn't break the altitude restriction on the SID (5000 feet), there was no IFR traffic of consequence. Traffic was CME123T PA31 doing a simulated ILS runway 03 approach. TCAS report completed by NAV Can.
