Incident at 20 MILES WEST OF OYSTER (ATS operating irregularity)


1997-05-30: Three A/C Involved: NWA39, DC10, North West Airlines. Amsterdam/Schihol to Boston. BAW2173, B767, British Airways. London/Gatwick to New York. AAL99, B767, American Airlines Brussels/National to New York. NWA39 at FL330, BAW2173 at FL350 and AAL99 at FL390 were westbound. Routing for all via OYSTER TOPPS. AAL99 was the lead aircraft at approx. 10 miles ahead of BAW2173 and NWA39. The spacing between BAW2173 and NWA39 was less than one mile. All three aircraft were radar identified. The controller asked NWA39 if it wanted a higher flight level and NWA39 requested and received clearence to FL350. NWA39 immediately asked if BAW2173 was at FL 350. The controller, believing BAW2173 was the lead aircraft, cancelled the clearance to Fl 350. TSB closed
