Incident at THUNDER BAY ON (CYQT) (ATS operating irregularity)
1996-12-10: Bearskin BLS308, a SW4, flight plan Sioux Lookout R6 Thunder Bay was inbound to Thunder Bay on descent to 11000 feet. THU102, a BE10, flight plan Thunder Bay direct Dryden requesting 16000 was on departure. Due to a conflict between their tracks the controller decided on an over/under procedure to separate them. To accomplish this THU102 was cleared to maintain 10000. THU102 had an inoperative MODEC readout. Shortly after BLS308 made initial contact with Thunder Bay TCU. The controller passed traffic information to him on THU102, who was believed to be at 10000. At about this time THU102 reported level at 11000 feet. The controller confirmed that THU102 was level at 11000 and immediately turned him right to a heading of 360 degrees. The aircraft came to within 1.15 NM of each other. UPDATE: The required separation is 3 miles. Thunder 102 mode C readout was not operative at the time of the loss and the controller did not have an altitude tag. ACC is submitting a violation report and conducting a unit management investigation.
