Incident at Regina, Saskatchewan (ATS operating irregularity)
Summary
1996-04-04: Gander 13A, a Bell 212 military helicopter was IFR to Moose Jaw from Shilo at 6000 feet. Athabaska 703 had been cleared to depart 13 at Regina on a routing direct Brandon/Winnipeg with a restriction to maintain 5000 feet. On initial contact with Regina TCU again instructed ABS703 to maintain 5000 feet. The pilot read the clearance back correctly, traffic was passed to both pilots by ATC and both crews advised ATC that they had visual contact with each other. ABS703 was then observed to climb through the restriction to 5400 feet. The controller immediately informed ABS703 and the pilot descended back down to 5000 feet. The two aircraft passed within two miles lateral and 600 vertical separation. TSB are not investigating. ATC will not be conducting a Fact Finding Board.
