Incident at Au dessus de Montréal (Conflict - loss of separation, ATS operating irregularity)

Update #1: TSB investigation class and number inserted. The TSB reported that ACA 605 westbound to Toronto, which was maintaining flight level 350, entered into conflict over Montreal with eastbound JZA 8018, which was climbing to flight level 370. Separation between the two aircraft was reduced to 1,800 vertical ft and 4.7 horizontal NM. The required separation was 5 horizontal NM and 2000 vertical ft. The controller realized that separation could be compromised when the aircraft were situated at 40NM from one another. He asked the A321 and the RJ to turn 40° to the left. The RJ did not react to this request, nor to the subsequent request to climb more rapidly because the controller used the wrong call sign (JZA8008).
While climbing to FL370, Air Canada Jazz regional jet JZA8018, en route to Quebec City (CYQB), crossed the path of Air Canada Airbus 321 ACA605, which was en route to Toronto (CYYZ), in level flight at FL350. The 5 NM minimum separation was not observed.
