A loss of separation occurred between a British Airways Boeing 787-9 (BAW99+) on a flight from London, England (EGLL) to Toronto/Lester B. Pearson, ON (CYYZ) and a Sata Internacional Azores Airlines Airbus A330-200 (RZO321+) on a flight from Ponta Delgada, Portugal (LPPD) to Toronto/Lester B. Pearson, ON (CYYZ) when being vectored for the instrument landing system (ILS) Runway 23 and ILS Rwy 24R respectively. No operational impact.
UPDATE: TSB Report#A17O0128: BAW99, a Boeing 787-9 aircraft operated by British Airways, was being vectored for the ILS RWY 23 approach into Toronto/Lester B. Pearson Intl, ON (CYYZ). RZO321, an Airbus A330-200 aircraft operated by Azores Airlines, was being vectored for the ILS RWY 24R approach into CYYZ as well. During BAW99's intercept of the localizer for Runway 23, the separation between the two aircraft reduced to 2.3 nautical miles instead of the required 3 nautical miles. No evasive action was taken by either aircraft.

When queried by controller, the pilot indicated that the auto-pilot was unserviceable. The flight requested to return to KBOS. No assistance required. No traffic, and no impact to operation.

Incident at TORONTO / LESTER B. PEARSON INTL ON (CYYZ)

An Airbus A310 (CSTKN / RZO320) from Toronto, ON (CYYZ) to Ponta Delgada, Portugal (LPPD), departed CYYZ Runway 23 and subsequently declared and emergency due to smoke in the cockpit. Aircraft Rescue and Fire Fighting (ARFF) was dispatched. RZO320 returned, landed CYYZ Runway 23 at 0220Z, and taxied to the gate.
UPDATE: TSB Report #A15O0140: The SATA International Airbus A310, CS-TKN, operating as flight RZO320, was departing Toronto (CYYZ) destined for Ponta Delgada, Portugal (LPPD). On take-off, when approaching V1, the crew noticed a strong smell of burning and some visible smoke. The take-off was continued, however shortly after, an emergency was declared and the aircraft returned to CYYZ. Maintenance found the #1 Pack air cycle machine (ACM) inoperative due to a defective cooling turbine. The unit was replaced, tested, and the aircraft was returned to service.

Previous departure was a Sata Internacional Airbus A330-200 (RZO320) from Toronto, ON (CYYZ) to Ponta Delgada, Sao Miguel Island PT (LPPD) that was 4.6NM ahead in the left turn out of 4,000 feet.

An Air Canada Boeing 767-375 (C-FOCA / ACA792) from Los Angeles, CA (KLAX) to Toronto, ON (CYYZ) was instructed to initiate a missed approach to Runway 05 due to a previous landing aircraft, a SATA Internacional Airbus A310 (CSTGV / RZO301) from Ponta Delgada, Portugal (LPPD) to Toronto, ON (CYYZ), missing an anticipated high speed exit and a departing aircraft in position, waiting to depart. ACA792 landed on Runway 05 at 0129Z without further incident.

Incident at JEBBY INTERSECTION

The Controller noticed a uncorrelated target, a SATA Airlines Airbus A310 (RZO220) from Boston, MA (KBOS) to Ponta Delgada Joao Paulo II, Sao Miguel Island (LPPD), encroaching on Moncton Airspace from NY Oceanic Airspace. NY Oceannic was contacted and the flight plan on file with NY indicated the flight on a route of DOVEY direct 4200N05000W which keeps the aircraft south of Moncton airspace. The aircraft eventually progressed JEBBY with Moncton and after the pilot was queried they indicated that they had been cleared DOVEY JEBBY 4200N05000W. The dispcrepency was passed on to NY Oceanic. No impact on operation and separation issues.

Moncton controller identified the error when the aircraft was 3 minutes over due at JEBBY. NY Oceanic was contacted and after a preliminary investigation it was identified as pilot error. No impact on operations.

The aircraft descended to 32,000 feet and experienced another brief period of moderate to severe turbulence.

N206TL, Cessna T206H, enroute from Saint-Pierre (LFVP) to Azores (LPPD), was cleared 4640N050W 4530N045W 4530N040W 4220N035W 40N030W at 21,000 ft. The aircraft was not HF radio equipped. On relay through another aircraft at 4530N045W, the pilot indicated that the flight was continuing direct 4220N035W. Attempts to confirm and re-clear the aircraft were not successful. The aircraft later confirmed through another relay that it had travelled direct 4220N35W.

The Air Canada Boeing 767-300 series aircraft (operating as flight ACA836) was on a scheduled IFR flight from Toronto (LBPIA) (CYYZ) to Madrid-Barajas International Airport, Spain (LEMD). The Federal Aviation Administration reported that an operational error occurred when S4-320 and ACA836 came within five (5) minutes separation (10 minutes required) at FL360 in New York Oceanic airspace. The Sata International Airbus A-310 aircraft (operating as flight RZO5321) was nearing the conclusion of a scheduled IFR flight from Ponta Delgada (João Paulo II) International Airport, Azores (Portugal) (LPPD) to Toronto (LBPIA) (CYYZ). The aircraft was approximately 80NM northeast of Toronto when the flight crew advised of a medical emergency on board and requested assistance at the gate. The Greater Toronto Airports Authority (G.T.A.A.) Airport Operations Control Centre (A.O.C.C.) staff were advised, priority handling was provided and the aircraft landed on runway 15L at 2331Z. Ops. impact -- unknown.

Incident at Approximately 25 Miles Southeast of Yarmouth (CYQI)

RZO2221, Airbus A310, enroute from Ponta Delgada (LPPD) to Boston (KBOS), declared PAN PAN PAN and reported an attitude deviation due to a computer malfunction. The problem was corrected quickly. The aircraft was observed on radar topping out at 39,500 ft. and then returning to the assigned 38,000 ft. No other aircraft were involved. There was minimal impact on ATS operations. TSB Case Closed.
UPDATE TSB: A09A0002: The SATA International A310-304, registration CS-TGV, operating as flight RZO2221 from Ponta Delgada, Azores to Boston, MA at FL 380, was approximately 25 NM east of Yarmouth, NS when the crew declared "PAN PAN PAN" and reported an altitude deviation due to a computer malfunction. The problem was corrected in short order; the aircraft was observed on radar topping out at FL395 then returning to FL380. No other aircraft were affected and the event had minimal impact on ATS operations.

The SATA Internacional Airbus 310-304 aircraft (operating as flight RZO301) was concluding a scheduled IFR flight from Ponta Delgada (João Paulo II) International Airport, São Miguel Island (Acores) (Portugal) (LPPD) to Toronto (LBPIA) (CYYZ). The aircraft landed on runway 23 at 2336Z without establishing contact with the Tower Controller. All attempts by both the Tower Controller and the Terminal Controller failed to establish contact although the Tower Controller did broadcast a landing clearance. The flight crew of RZO301 did establish contact after landing and exiting the runway. Ops. impact -- unknown.
