UPDATE: TSB Report #A21Q0049: C-GECT, a Cameron Air Service Ltd Pilatus PC12, was on an instrument flight rules flight from La Macaza/Mont Tremblant, QC (CYFJ) airport to Toronto/Billy Bishop, ON (CYTZ) airport. C-GECT had received and correctly reread clearance to climb to FL230. The ATC noted that C-GECT continued to climb to FL234. The controller queried C-GECT regarding its altitude, and the aircraft recognized the error and returned to the assigned flight level. There was a loss of separation with a WestJet Encore de Havilland DHC-8-402 (C-GDEW), under callsign WEN3409, that was on an instrument flight rules flight from Quebec/Jean Lesage, QC (CYQB) airport to Toronto/Lester B. Pearson, ON (CYYZ) airport. Separation between C-GECT and C-GDEW was reduced to 4.4 nautical miles horizontally and 600 feet vertically, whereas the minimum required separation is 5 nautical miles horizontally and 1000 feet vertically.

A WestJet Encore Ltd. de Havilland DHC-8-402 (C-FWEZ/WEN3543) from Montreal/Pierre Elliott Trudeau, ON (CYUL) to Toronto/Lester B. Pearson, ON (CYYZ) was cleared to 5,000 feet. After briefly levelling off, the aircraft was observed at 5500 feet, 2.5NM behind a Jazz Bombardier CL-600-2D24 (C-GOJZ/JZA8970) from Ottawa/Macdonald-Cartier, ON (CYOW) to Montreal/Pierre Elliott Trudeau, QC (CYUL).
UPDATE from Flight Operations: A Civil Aviation Safety Inspector (CASI) looked into this occurrence. Shortly after departure, the crew was made aware of potential conflicting traffic 1000ft above their assigned altitude. Visual confirmation of the traffic was made by the crew. At the time of acknowledging and passing the conflicting traffic, the crew was assigned a heading by air traffic control (ATC). The pilot that was flying, upon hearing the instruction given by ATC, began to both initiate the turn (as directed), but also self-initiated a climb. The climb was initiated in error due to the flying pilot anticipating a higher altitude because the potential traffic no longer posed a threat. The flying pilot quickly realized their error, and elected to gradually level off for guest comfort. The 400ft deviation in altitude can be attributed to the gradual altitude capture rather than an abrupt one (again, because the conflicting traffic posed no threat). The Flight Safety Standards pilot debriefed with the flight crew following the event, and reviewed the following contributing factors leading to the altitude deviation, which included: expectation of being assigned a clearance (i.e. confirmation bias); role transfer and the subtle disorientation operating from a seat not commonly occupied by the Pilot Flying (PF); and a lightly loaded aircraft, namely in increased climb performance.

Traffic was a privately registered Cessna 172L from Nanaimo, BC (CYCD) to Pitt Meadows, BC (CYPK). Traffic was passed, no operational impact.

A Flair Airlines Ltd. Boeing 737 MAX 8 (C-FLKC/FLE150) from Abbotsford, BC (CYXX) to Toronto/Lester B. Pearson, ON (CYYZ) departed from CYXX and was cleared direct IWACK, when safe. A subsequent turn was required due to a VFR aircraft, an Abbotsford Flying Club Piper PA-28-181 (C-GIUK) from Abbotsford, BC (CYXX) to Abbotsford, BC (CYXX), that was descending out of 6,000 feet and not in communication with air traffic control (ATC).

Incident at VICTORIA INTL BC (CYYJ) (FOD (foreign object debris))

A WestJet Boeing 737 MAX 8 (C-FNAX/WJA797) from Toronto/Lester B. Pearson, ON (CYYZ) to Victoria, BC (CYYJ) reported a bird strike when landing on Runway 27. The Aircraft Rescue and Fire Fighting (ARFF) unit responded and found the carcass of 1 swallow. WJA797 landed safely. No impact on operations.
